These Terms & Conditions apply to your use of the Blood Records website and to purchases made from Blood Records Limited.

Please read these Terms carefully before placing an order.

1. About Us

This website is operated by Blood Records Limited (“Blood Records”, “we”, “us” or “our”).

When you place an order through our website, your contract for the purchase of goods is with Blood Records Limited.

Our orders may be fulfilled on our behalf by specialist third-party fulfilment providers. The use of a fulfilment provider does not change who your contract is with.

2. Using Our Website

You may use our website only for lawful purposes.

You must not misuse the website, attempt to gain unauthorised access to it, interfere with its operation, introduce malicious code, or use automated systems in a manner that adversely affects the website or other customers.

We may suspend, restrict or withdraw access to all or part of the website where reasonably necessary, including for maintenance, security or operational reasons.

3. Product Information

We take reasonable care to ensure that product descriptions, images, specifications, prices and other information displayed on our website are accurate.

However, colours and appearance may vary depending on your device or display settings, and certain products may naturally vary as a result of their manufacturing process.

Product images may sometimes be digital renders, mock-ups or pre-production samples where finished production copies are not yet available.

Any material product characteristics will be described on the relevant product page.

4. Vinyl Manufacturing Variations

Vinyl records are manufactured using physical production processes which can result in minor variations between individual copies. This is particularly common with coloured, splatter, marble, swirl, picture-disc and other special-effect vinyl.

Colours, patterns, positioning, opacity, blending and other visual characteristics may vary from the product images shown on our website and from one copy to another. Product images are therefore representative of the intended design and appearance rather than a guarantee that every copy will be visually identical.

Special-effect sleeves, packaging and finishes may also display natural manufacturing variations. This may include variations in the positioning, pattern, colour, texture, coverage, reflectivity or appearance of effects such as foil, holographic, lenticular, metallic, spot-varnish, embossed, debossed, die-cut or other specialist finishes.

Minor manufacturing marks or variations that are inherent in these production processes and which do not materially affect the product's appearance, functionality or vinyl playback will not normally be considered faults or defects.

This does not affect your statutory rights where a product is faulty, damaged, not as described or otherwise fails to meet the standards required by applicable consumer law.

5. Availability and Limited Editions

Many Blood Records vinyl releases are manufactured in strictly limited quantities.

The availability of a product on our website does not guarantee that an order can always be fulfilled. Stock discrepancies, technical errors, damaged inventory or other circumstances may occasionally result in a product becoming unavailable after an order has been placed.

Where we are unable to fulfil an order, we will contact you and refund any amount paid for the affected product.

Where a product is described as limited to a particular quantity, this refers to the intended edition or production quantity unless otherwise stated.

Small quantities may be retained or subsequently become available as a result of cancellations, failed payments, returns, replacements, production overruns or stock reconciliation.

6. Personal Use, Purchase Limits and Resale

Blood Records products are intended for purchase by genuine customers for personal use.

Where a product page specifies a maximum purchase quantity, that limit applies per customer, household or other reasonable identifying criteria we may use to enforce the restriction.

You must not attempt to circumvent purchase limits by placing multiple orders, using multiple customer accounts, email addresses, payment methods, delivery addresses or other means.

We reserve the right to cancel or reduce orders where we reasonably believe that purchase limits have been circumvented, an order has been placed primarily for commercial resale, or purchasing activity is otherwise inconsistent with the stated conditions of sale.

Where appropriate, we may also restrict future purchases by customers or accounts that repeatedly breach these conditions.

Nothing in these Terms prevents the lawful resale of goods where such resale cannot legally be restricted. However, purchasing products primarily for unauthorised commercial resale may result in future orders being refused or cancelled.

7. Orders

Placing an order constitutes an offer to purchase the products in your basket.

After you place an order, you will normally receive an order confirmation email acknowledging receipt of your order.

We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including where:

  • a product is unavailable;

  • payment has not been authorised or has subsequently failed;

  • an obvious pricing or product information error has occurred;

  • we reasonably suspect fraud or other unlawful activity;

  • applicable purchase limits have been exceeded or circumvented;

  • we reasonably believe the order has been placed primarily for unauthorised commercial resale; or

  • we are unable to deliver the product to the destination requested.

Where we cancel an order after payment has been taken, we will refund the relevant amount.

8. Prices and Payment

Prices are displayed in the currency applicable to your selected market or location where supported by our website.

The total price payable, including applicable taxes collected by us and delivery charges, will be shown at checkout before you place your order.

For international orders, additional customs duties, import taxes or charges may be payable where these have not been collected at checkout.

Payment must be made using one of the payment methods offered at checkout.

9. Pricing Errors

We take reasonable care to ensure that prices displayed on our website are correct.

Occasionally, an obvious pricing error may occur.

Where we identify an obvious error before dispatch, we may contact you to offer the opportunity to purchase the product at the correct price or cancel the affected order and issue a refund.

We will not rely on this provision to cancel an order merely because we later decide that the advertised price was commercially unfavourable.

10. Pre-Orders

Many Blood Records vinyl releases are offered for sale before manufacturing has been completed.

Estimated release and dispatch dates are provided in good faith based on the information available to us at the time but may change.

Manufacturing schedules, artist or label requirements, logistics and circumstances outside our reasonable control may result in delays.

Where a release or dispatch date changes materially, we will endeavour to update the relevant information and/or contact affected customers where appropriate.

Unless otherwise stated, orders containing multiple products may be held until all products within the relevant shipment are available.

11. Delivery

Delivery options, charges and estimated delivery times will be displayed at checkout where available.

Delivery estimates generally begin from dispatch and are not guaranteed unless expressly stated otherwise.

Risk in the goods passes to you when the goods are delivered to you or to a person identified by you to receive them, subject to applicable law.

12. Customs and Import Charges

Orders delivered outside the United Kingdom may be subject to customs duties, import taxes, handling charges or other fees imposed by the destination country.

Where these amounts have not been collected by us at checkout, they are normally the responsibility of the recipient.

We do not control charges imposed by customs authorities and cannot guarantee their amount.

13. Cancellations and Returns

Your cancellation and return rights depend on your location, the product purchased and the circumstances of the return.

We also offer eligible customers a 30-day returns period as described in our Shipping & Returns Policy.

For certain sealed vinyl records, statutory change-of-mind cancellation rights may cease once the seal has been broken, where permitted by applicable law. UK law specifically provides for this exception in relation to sealed audio recordings.

14. Faulty, Damaged or Incorrect Products

Products must meet the standards required by applicable consumer law.

If you receive a product that is faulty, damaged, defective, incorrect or materially not as described, please contact us as soon as reasonably possible after discovering the issue.

If you wish to exercise the UK short-term right to reject faulty goods, this will generally need to be done within 30 days of receiving the goods. Other statutory remedies may continue to apply after this period.

Depending on the circumstances and your applicable rights, an appropriate resolution may include a replacement component, partial refund, complete replacement or refund.

As explained in Section 4 (Vinyl Manufacturing Variations), minor variations inherent in vinyl manufacturing or specialist printing and finishing processes will not normally constitute a fault or defect simply because one copy differs slightly from another or from representative product imagery.

15. Merchandise

Blood Records may also sell merchandise including clothing, accessories and other non-vinyl products.

Product descriptions will provide relevant information such as sizing, materials or other important characteristics where applicable.

Merchandise returns are subject to our Shipping & Returns Policy and your applicable statutory rights.

16. Product Safety and EU General Safety Product Regulation (GSPR)

We take reasonable steps to ensure that products we sell comply with applicable product safety requirements.

Where the EU General Safety Product Regulation (EU) 2023/988 (GPSR) applies to products offered to customers in the European Union, relevant product safety and traceability information will be provided as required by law.

This may include information identifying the manufacturer and, where required, the responsible economic operator established in the European Union, together with relevant product identification, contact and safety information. GPSR requires specified manufacturer/responsible-person and product-identification information to be made available for products offered online where applicable. 

If you have a product safety concern about an item purchased from Blood Records, please contact us at info@blood-records.co.uk, including your order number and details of the product and concern where possible.

Where we become aware of a product safety issue requiring action, we may contact affected customers and take appropriate steps, which may include providing safety information, withdrawing a product, arranging a return or implementing a recall.

17. Intellectual Property

Unless otherwise stated, the content of this website, including Blood Records branding, website design, text, graphics and original content, is owned by or licensed to Blood Records Limited and is protected by applicable intellectual property laws.

Artist names, artwork, photographs, logos, album artwork and other third-party intellectual property remain the property of their respective owners or licensors.

You may not reproduce, distribute, commercially exploit or otherwise use website content without the permission of the relevant rights holder, except where permitted by law.

18. User Content and Reviews

Where our website allows you to submit reviews, comments, photographs or other content, you are responsible for ensuring that you have the right to submit that content.

Content must not be unlawful, abusive, defamatory, misleading, infringing or otherwise inappropriate.

We may moderate or remove user-submitted content where reasonably necessary.

19. Website Availability

We aim to keep our website available and operating correctly but cannot guarantee uninterrupted or error-free access.

We may temporarily suspend or restrict the website for maintenance, updates, security or circumstances outside our reasonable control.

20. Third-Party Services and Links

Our website may use or link to services operated by third parties, including payment providers, delivery providers and other technology services.

We are not responsible for the content or availability of unrelated third-party websites that we do not operate.

21. Our Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable when the contract was formed or for business losses suffered by a consumer.

Nothing in this section affects any rights or remedies that cannot lawfully be excluded or limited.

22. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by events outside our reasonable control.

These may include manufacturing disruption, industrial action, transport disruption, severe weather, natural disasters, failures of telecommunications or logistics networks, government action or other comparable circumstances.

Where such an event materially affects an order, we will take reasonable steps to minimise the impact and communicate with affected customers where appropriate.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, services or applicable law.

The Terms that apply to your purchase will normally be those in force when you place your order.

Changes made after an order has been placed will not retrospectively alter your contract except where required by law or agreed with you.

24. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue in effect.

25. No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

26. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere, you may also benefit from mandatory protections provided by the laws of your country of residence.

Nothing in these Terms is intended to deprive you of any mandatory consumer protections or rights relating to where proceedings may be brought.
